Practical Tips For Navigating Cybersecurity & Data Privacy Issues In Arbitration (Hybrid)

Effective January 2023, New York instituted a mandatory CLE requirement in the Cybersecurity, Privacy and Data Protection category. To assist counsel and arbitrators in addressing these issues in the context of ADR, this program will provide practical guidance for assessing information security risks, identifying available measures that may be used to address information security, and navigating the patchwork of state and federal laws that govern information security and data privacy. The program will review the updated 2022 edition of the ICCA-NYC Bar-CPR Protocol on Cybersecurity which provides a framework for parties and tribunals to establish reasonable information security measures in both domestic and international arbitrations, including new guidance on what to do in the event of a data breach. Participants in this program will receive CLE credit that satisfies New York’s new requirement.
