The heart of this program, which is geared to experienced matrimonial lawyers, is how you may better represent your clients when dealing with valuation issues, especially in a closely-held business or professional practice, and with various forms of executive compensation.
The program begins with the always useful review of the latest cases, legislation and trends in matrimonial and family law. Then, working as a team, financial experts and matrimonial lawyers at each location will offer a thorough, detailed analysis of valuation and executive compensation in the context of equitable distribution.
The substantive law – and the methodologies that may be utilized and accepted by the courts – in the valuation of particular assets, especially businesses, professional practices and executive compensation, will be addressed. The panelists will discuss not only the governing law and rules but also the practical considerations for the lawyer’s strategy involving such important elements as: the “date of commencement” and the “date of trial” in assessing value; enhanced earnings and double-dipping; classification of assets as marital or separate (e.g., is a particular form of executive compensation for past or future services?); the necessity of proof and on whom the burden falls and can it be shifted?; the tax implications of the asset’s valuation and distribution.
At the end of the program, you should have a greater sense of how to develop and plan with the financial expert your case strategy and how you can effectively use the expert’s approach and analysis in your advocacy.
