Estate Planning for Loved Ones with Mental Health and/or Substance Use Disorders

A discussion of the role of a trusted advisor in discussing and planning for mental health and substance abuse issues within the family, including an overview of the breadth of the problem in our society today, discussion of how these issues have an impact on an individual’s ability to manage an inheritance and/or to serve as a fiduciary, identifying red flags to look for, examining preferred language in estate planning documents (dynasty trusts, protective trusts), decanting trusts and examining what happens when an estate plan goes wrong.
