HIPAA/HITECH For Lawyers Update (2014)

On September 23, 2013, the U.S. Department of Health and Human Services began to enforce the long-awaited HITECH Omnibus Regulations released January 17, 2013 (the “Final Rule”). The Final Rule made sweeping changes to HIPAA Privacy and Security Rules, increased civil monetary penalties dramatically, and extended liability to Covered Entities’ Business Associates, including attorneys.

 

This program will:

         – Provide an overview of the Final Rule

         – Review enforcement activity to date and offer advice on how to prepare clients for audits

         – Familiarize attorneys with Department of Health and Human Services guidance on HIPAA and Mental Health information, including review of the overlapping State Law provisions related to confidentiality of Mental Health information

         – Explore E-Discovery obligations for In-House and Business Associate attorneys in the context of the Final Rule
