This program will explore the impact of social media on conflicts of interest as they apply to attorneys, along with strategies to mitigate associated risks. Particular attention will be paid to the New York Rules of Professional Conduct governing the duty of confidentiality, the duty to avoid the representation of differing interests and the duty of loyalty or independent judgment to the client. The following rules – and the impact of social media on these rules – will be discussed:
