Justice Shirley Troutman Named to Court of Appeals

Good morning Members,

Associate Justice Shirley Troutman of the Appellate Division, Fourth Department, has been nominated by Gov. Kathy Hochul to become a judge on the Court of Appeals.

Before joining the court in 2016, she was a justice for the Erie County Supreme Court in the 8th Judicial District, a Buffalo City Court judge, an assistant United States attorney for the Western District of New York, an assistant state attorney general and an assistant district attorney in Erie County.

“Justice Troutman brings to the Court of Appeals invaluable experience as a prosecutor, trial court judge and appellate justice,” said T. Andrew Brown, president of the New York State Bar Association. “She is a true champion for justice, diversity, and inclusion. Her appointment underscores the importance of a diverse judiciary. We commend the governor on this superb choice.”

She will fill the vacancy created by Judge Eugene Fahey, who retires from the court on Dec. 31.

The New York State Bar Association has rated Justice Troutman as “well qualified” to serve on the state’s highest court.

Hon. Hector LaSalle, presiding justice of the Appellate Division, Second Department, has appointed Maria T. Fasulo as clerk of the court. In recent months, she had been serving as acting clerk of the court, which hears civil and criminal appeals from the trial courts in the counties of Dutchess, Kings, Queens, Nassau, Orange, Putnam, Richmond, Rockland, Suffolk and Westchester.

“She is eminently qualified to take on the challenges of this critical position, exemplifying the qualities we expect of our court leadership — knowledge, integrity, a strong work ethic and an unwavering commitment to excellence — and will be a valuable partner in our ongoing efforts to better serve the public,” LaSalle said.
