As the cryptocurrency market has developed explosively over the past decade, the legal community has been facing various challenges.  Particularly, as a result of the sudden collapse of FTX, the legal community now faces various unprecedented legal issues associated with the cryptocurrency market.  This webinar will help you navigate those issues and help you protect your clients from the ongoing FTX case.  It will also discuss the U.S. and the EU’s regulatory responses to digital asset exchanges.

Speaker Erin Broderick of Eversheds Sutherland is currently lead counsel to the Ad Hoc Committee of Non-U.S. Customers of FTX.com, representing over $2.25 billion in claims, in FTX’s chapter 11 case.  She will provide an overview of the status of the FTX cases and key takeaways for exchange customers to protect their interests in the FTX bankruptcy as well as more broadly in other crypto chapter 11 cases.

Howard Fischer of Moses Singer, a former senior trial counsel at the SEC will discuss the SEC and criminal cases involving FTX and outline what they mean for the future of crypto exchanges, especially in light of the recent enforcement actions relating to Binance and CoinBase. 

Piotr Wojtowicz of Allegra Law, f/k/a Heuking Kuhn Luer Wojtek Switzerland, will discuss how the EU’s MiCA and Swiss DLT frameworks focus on a “before the fact” regulation, creating a favorable environment for innovation, and introducing comprehensive regulations, in lieu of the “after the fact” enforcement of the SEC acting against the backdrop of a fragmented regulatory landscape with multiple agencies overseeing different aspects of crypto-assets.  He will also discuss the FTX case from a Swiss FTX subsidiary’s perspective.
