Kathleen Sweet, president of the New York State Bar Association, issued the following statement today about the U.S. Supreme Court’s ruling on birthright citizenship:

“The U.S. Supreme Court did not rule today on the constitutionality of birthright citizenship but on the right of federal judges to issue nationwide injunctions pausing the administration’s Executive Orders. The 14th Amendment of the U.S. Constitution grants citizenship to every baby born in the United States with limited exceptions. The district and appellate courts that have ruled on the constitutionality of the administration’s Executive Order denying birthright citizenship to babies born to undocumented immigrants have found it violates the U.S. Constitution. It is a sacred document and the foundation of our system of government; it guarantees due process and establishes the rule of law.”

“As stated by Justice Sotomayor, the court’s decision to restrict nationwide injunctions of Executive Orders is nothing less than an open invitation for the government to bypass the Constitution. The Executive Branch can now enforce policies that flout settled law and violate countless individuals’ constitutional rights, and the federal courts will be hamstrung to stop its actions fully.”
