This program will explore the evolving landscape of product repair aftermarkets and the competitive issues they present for consumers, independent repair businesses, and manufacturers. We’ll begin with a high-level overview of the intersection between intellectual property, safety concerns, and antitrust law—introducing key legal frameworks and the seminal Eastman Kodak case. We’ll then examine recent right-to-repair developments, including state legislative initiatives and high-profile litigation involving companies such as Apple, Harley-Davidson, and Deere & Co.

The session will culminate in a “fireside chat” discussion with Ken Dintzer, a current partner at Crowell & Moring and former DOJ trial attorney responsible for some of the most high-profile antitrust litigation in decades, and policy advocate Nathan Proctor, who leads PIRG’s right to repair campaign on behalf of US consumers.
