The economic pressure related to the COVID-19 pandemic has quickly pushed thinly financed businesses to file for bankruptcy with very little warning to creditors, and contributed to a 26% percent increase in business bankruptcy filings during the first half of this year over last. There is expected to be a corresponding increase in adversary complaints filed by debtors in possession/trustees to recover payments made to creditors within the 90-day period prior to case commencement. This program will discuss possible defenses to preferential transfer actions, including the role that mediation and expert testimony may play, recent changes to the Bankruptcy Code that affect these proceedings, and what attorneys can anticipate will occur over the next 6-12 months as government life lines to businesses and individuals come to an end.
