“Unprecedented” is a word that has been on everyone’s mind over the past few years, and not only to describe the pandemic: new assets like NFTs and cryptocurrency, new technologies that allow meetings in virtual spaces, and trends like socially responsible investing, have had tremendous impact on how we and our clients experience the world. How do our existing best practices approach unconventional assets and uncertain markets? How have these new trends pushed the legal practice forward with new and creative solutions? Where do precedents need updating? This program will provide a toolbox for fiduciaries and their counsel, planners, and litigators, on how to approach “unprecedented times” using the precedents we have and looking forward to how these may develop in the future.

Session I – Digital Assets Past & Present

This session will include a brief overview of the Digital Asset legislation in New York and then discuss new digital asset classes and technologies such as the Blockchain, NFTs, the Metaverse, and cryptocurrencies. This session will also explore various approaches to discussing ownership of planning with and valuation of these assets with clients, including how to address estate or trust ownership in estate planning documents and dealing with the fiduciary responsibilities of administering these assets.
