In a highly politicized world, not-for-profit organizations are facing heightened public scrutiny and criticism from lawmakers and public officials. A growing number of federal and state legislative proposals could have significant impacts on not-for-profit organizations, including new administrative burdens, material limitations on activities, increased taxes on income, and in some cases, existential threats. At the same time, judicial decisions in areas such as discrimination, women’s health, social welfare organizations, and deference to administrative agencies are rapidly changing the legal landscape in which many not-for-profit organizations operate. This session will provide an overview of recent changes and notable new proposals and then focus on practical advice for scenario-planning and risk mitigation in the face of potential, but unpredictable, changes in law.
