The Face of IP: Trade Dress in the Beauty and Cosmetics Industry

In the beauty and cosmetics industry, branding is everything. From packaging design to signature color schemes, these design elements create a distinct brand identity that drives consumer loyalty and market differentiation. Intellectual property, particularly trade dress, plays a critical role in protecting this brand identity.

This panel will explore what trade dress is, the elements that are protectible in the beauty space, and how these protections have evolved over time. We’ll examine high-profile examples and discuss the rise of “dupe culture” and its legal implications. Through a review of recent trade dress litigation our panelists will analyze when dupes cross the line into infringement.
