1. Advanced Mediation Techniques: A panel discussion offering practitioners practical tips, strategies, and techniques for approaching and succeeding in mediation. Topics will include preparation best practices, effective advocacy during mediation sessions, and navigating common obstacles to resolution.
2. Anatomy of an Internal Investigation: A comprehensive panel tracing the full lifecycle of a corporate internal investigation, from identifying the triggering issue through retaining and engaging counsel, conducting the investigation, managing document preservation and witness interviews, and preparing and delivering the investigative report.
3. Trusts & Estates Litigation for Commercial Litigators: A panel discussion addressing the trusts and estates issues that commercial litigators regularly encounter in practice. Topics will cover what every commercial litigator needs to know when their matters intersect with estates, trusts, fiduciary disputes, and surrogate court proceedings.

Highlights and Objectives:

The objective of this program is to ensure that NYSBA members practicing within commercial litigation gain practical, immediately applicable skills in advanced mediation techniques, develop a thorough understanding of how to manage every phase of a corporate internal investigation, and acquire working knowledge of the trusts and estates concepts and proceedings they are likely to encounter in commercial litigation practice.
