Planning for and Addressing Changed Circumstances
We live in a time where the need for flexibility in estate planning is more pressing than ever. Circumstances concerning beneficiaries may change dramatically overnight, the current federal estate, gift and generation-skipping transfer tax exclusion amounts are scheduled to sunset after December 31, 2025, and the Corporate Transparency Act portends to impose significant new obligations on our clients in reporting their closely held entities, beneficial owners and company applicants. Moreover, we live in a time of transformational changes in technology (including new far-reaching applications for artificial intelligence) that will no doubt significantly affect the estate planning that we do for our clients. This program will address all of this, and provide a toolbox for estate planners, fiduciaries, and litigators so that they can get ahead of this rising tide before it manifests, and address changed circumstances once they have occurred.
Key Highlights and Objectives
- Learn what tools are available to plan for and address changed circumstances when drafting and administering irrevocable trusts including the use of trust protectors and trust modifications, permissible retained powers, and provisions allowing beneficiary control over trust assets and distributions.
- Learn how to approach the impending sunset of the doubled federal estate, gift and GST tax exclusion amounts after December 31, 2025, and how to avoid a potential “clawback” situation under the IRS regulations and lingering related concerns.

The Estate Planner’s Guide to the Corporate Transparency Act
The United States is catching up with the rest of the world. With the recent enactment of the Corporate Transparency Act, certain domestic and foreign entities will be required to submit specified ownership Information to the Treasury Department, which could then be shared with certain Government agencies, financial institutions, and regulators. In an effort to enhance transparency, CTA’s reporting requirements target generally smaller, more lightly regulated entities that may not be subject to any other reporting requirements, while exempting more heavily regulated entities. This session will focus on the law’s reporting requirements and the final regulations that have been issued by Treasury’s FinCEN group to implement the CTA. The session will also focus on specific information to be reported, reporting deadlines, open issues and penalties for non-compliance.
