Mediate, arbitrate, or wait? That is the question on the mind of every attorney. With the reality of an extended and gradual return to “normal” and the likelihood of disrupted court dockets for many months, we are all feeling the increased pressure to consider virtual options. The most daunting challenge is figuring out more about how these processes work. Are they secure? Are they confidential? Are they fair? Do they yield enforceable awards? Can we make progress and settle matters? How can we zealously advocate from our “home” offices? Does virtual ADR work?

The answer—learn more, get start getting your fee wet. Join ComFed members for the first of two sessions featuring a live, interactive mock virtual mediation (mock virtual arbitration proceeding to follow soon). JAMS neutral TBD will lead advocates and parties (played by ComFed members TBD)  through a hypothetical—but very real—virtual mediation session on Zoom. This process will illustrate how current technological platforms function, including:

  • Important new factors to consider in the pre-session preparation steps,
  • Getting comfortable with the virtual platform (addressing privacy and confidentiality concerns, building comfort with the new bells and whistles, lining up alternate simultaneous communication channels)
  • Advocacy tips for this “new normal” (facilitating meaningful connections and reading the virtual room, remote testimony techniques, successfully sharing exhibits, signing and executing agreements)

Our intrepid players will “freeze” the process along the way to highlight common challenges and possible efficiencies. Submit your questions in real time, and get familiar with these ADR options.
