Litigation Funding and Alternative Dispute Resolution – Exploring Positives and Negatives

Litigation Funding and Alternative Dispute Resolution – Exploring Positives and Negatives
Panelists will explore ethical and legal implications of the use of third-party litigation funding in ADR, including what happens when a disputant’s goals and strategy diverge from the goals and strategies of its third party funder, and whether information that is otherwise confidential or privileged loses its status when shared by a disputant with its third party funder? Panelists also will share perspectives on whether third-party litigation funding should be regulated, and if so, what regulations or changes should be implemented.
