A lively discussion with Justice Jerry Garguilo, who presided over the recent New York Opioid Trial, and Justice Elizabeth Emerson. In addition to the Opioid Trial and Climate Science topics, we will discuss with the Judges questions relating to the Commercial Division part rules (separate from the CPLR) and whether or not they permit counsel to waive any of those rules assuming both sides consent, their policy with respect to how they conduct bench trials, and their current policy with respect to virtual court appearances in the wake of Covid.
