The Business Case for Alternative Dispute Resolution (ADR)
Conflict in business is inevitable. Businesses are made up of individuals with different values, views, styles and ideas and such differences often are beneficial to a business, resulting in growth and success. However, when these differences diverge, conflicts ensue, often resulting in a time consuming and costly distraction to the business.
Whether dealing with conflicts that are internal or external to the business, those involving employees, vendors, partners, or others, ADR techniques can be utilized to resolve conflict in an efficient and cost-effective manner while maintaining important relationships and allowing business leaders to focus on day-to-day business matters.
This program will discuss the benefits to businesses of using ADR techniques such as negotiation, mediation, and arbitration to resolve conflict and how business lawyers can include ADR as part of their recommendations to clients in connection with contract drafting or development of a business’s dispute resolution framework. Additionally, the program will address some preconceived notions about ADR that often cause it to not be in a business lawyers' regular toolbox.
