Make Your Voice Heard: NYSBA Urges Members To Submit Comments on DOJ Proposal

President Kathleen Marie Sweet is encouraging members to take action and submit comments on the U.S. Department of Justice’s proposed rule, “Review of State Bar Complaints and Allegations Against Department of Justice Attorneys,” before the April 6 deadline. The input and expertise of our members will play a significant role in shaping the rulemaking process and ensuring that the perspective of the legal profession is fully represented.

NYSBA has already filed a comment letter opposing the proposal, which raises concerns that the rule conflicts with existing law and undermines the judiciary’s role in regulating attorney conduct. Sweet urges members to review the proposal and share their perspectives. Individual comments from practicing attorneys can help inform federal decision-makers and reinforce the importance of maintaining independent, court-administered disciplinary systems.

At its core, the issue affects a foundational principle of the profession: all attorneys are bound by the same ethical rules and should be subject to the same disciplinary framework. Preserving that principle depends not only on institutional advocacy, but on engagement from members across the state.
