New York State Bar Association Clarifies its Position on Discovery

New York State Bar Association President Domenick Napoletano issued the following statement:
“In 2015, the New York State Bar Association examined criminal discovery rules in detail, taking care to consider input from experts and practitioners – both defense attorneys and prosecutors.
“Much has changed since 2015. Not the least of which was the enactment of New York’s discovery reform laws, which took effect in 2020.
“The New York State Bar Association has not taken a position on the totality of Gov. Hochul’s proposed amendments to the discovery laws. Although some aspects of the governor’s proposal are consistent with the association’s 2015 report, other parts of the proposal have not been addressed by the association. We recognize the concerns raised about striking the right balance with any proposed changes. The association’s goal is not to take sides on this issue but to share with the governor and legislative leaders the detailed research and analysis contained in our reports. We trust they will take into account the perspectives of all relevant stakeholders on this important issue and will reach a resolution that will serve all New Yorkers.”
