The Ethics of Social Media in Litigation and Court
In this entertaining and enlightening course, we'll review how lawyers have used and have been caught by the inappropriate use of social media. These misuses have led to malpractice claims, sanctions, and professional disciplinary actions ranging from reprimand through complete disbarment.
Viewers see how inappropriate advice to clients to modify social media platforms have led to huge sanctions for spoliation, and dismissal of cases. Such advice can also result in the loss of attorney-client privilege.
You will be looking at inappropriate texting, photographing, posting, and such concerns as "false friending", as well as the newly-arising "duty to google" in some cases. This program finishes with a review of various state opinions, and best practices in all these areas, and includes the recommended use of Social Media Addendums to attorney fee agreements to warn clients of the hazards that using social media plays in litigation.
