Arbitrator Selection, Neutrality and In-Hearing Conduct in Insurance Arbitrations
Insurance coverage arbitrations have some unique aspects: in most cases each side (the policyholder and the insurer) chooses an arbitrator and the two arbitrators, with party participation, choose the Chair. The degree of neutrality of the wings varies from matter to matter and different providers have different rules and procedures governing this process. How the party appointed wings conduct themselves during the course of the arbitration and their interaction both to appoint a Chair and later with the neutral Chair during the arbitration, is a topic we will discuss. We will also look at a Second Circuit U.S. Court of Appeals ruling dealing with this topic. Our panel includes a former in-house counsel, arbitrators and arbitration providers. The program will be followed by a Networking Reception.
