James E. Dering joined the firm in 2015. Jim is a member of the firm’s Health Care and Home Care practice groups, and Chairs the firm’s Cannabis Law group.

With more than 30 years of experience, Jim represents health care providers of all types including but not limited to hospitals, diagnostic and treatment centers, nursing homes, adult homes, assisted living residences, physician practices, individual physicians and other licensed individuals, etc. This includes representing providers before the New York State Department of Health, the New York State Department of Education, and other state agencies, providing regulatory analysis and advice to clients, representing buyers and sellers in home care agency transactions, and meeting client’s needs in a variety of other types of matters. He also provides regulatory advice to Medical Cannabis Registered Organizations and to those seeking or involved with Adult Use Cannabis licensure.

Prior to joining Garfunkel Wild, Jim served as General Counsel of the New York State Department of Health (DOH or Department), and served as the Department’s Deputy General Counsel and Director of the Bureau of House Counsel earlier in his career. As General Counsel, Jim was the chief legal advisor to the Commissioner of Health and oversaw approximately 125 attorneys and staff. In addition to providing legal services to programs across DOH, Jim worked on the Department’s response to public health threats such as Hurricane Irene and Tropical Storm Lee, Superstorm Sandy, Ebola, Legionella, and synthetic marijuana and bath salts. He was also involved in implementation of legislation such as the Compassionate Care Act (Medical Marijuana Program) and the Marriage Equality Act.

Jim served as Bureau Chief of the New York State Attorney General’s Heath Care Bureau, and held other titles with the Office of the Attorney General (OAG) before that. At the OAG, he was a key member of the Attorney General’s Healthcare Industry Task Force for the Ingenix/Usual, Customary and Reasonable (UCR) investigation that resulted in settlements with insurers that included industry-wide changes to the national reimbursement system for out-of-network care, almost $100 million in settlement funds, and the creation of FAIR Health, Inc.

Jim began his career at an Albany, N.Y. law firm where he became a partner and practiced for more than 10 years. His practice included heath care, insurance and corporate law, as well as litigation.

Jim previously served as a Commissioner on the New York State Joint Commission on Public Ethics (appointed by Governor Andrew M. Cuomo). His volunteer activities have included serving as Trustee of the Albany College of Pharmacy and Health Sciences, President of the Bethlehem Central School District Board of Education, Vice Chair of the Public Health Sector Task Force of the American Health Lawyers Association, church trustee, lake association board member, and youth soccer and tennis coach.

Health Law Journal

The Health Law Journal features peer-reviewed substantive articles relating to the practice of health law on various topics including the Family Health Care Decisions Act, HIPAA, nursing homes, managed care, mental health, medical ethics, and long-term care. Also included are regular features on recent cases, legislation and publications, as well as updates on Section activities. Edited by Cassandra DiNova, Esq., the Health Law Journal is published by the Health Law Section and distributed to Section members free of charge.

The Journal is published as a benefit for members of the Health Law Section and is copyrighted by the New York State Bar Association.

The Health Law Journal encourages article submissions on topics of interest to members of the Section. Writing an article for a NYSBA Section publication is a great way to get your name out in the legal community and advertise your knowledge. Our authors are respected state-wide for their legal expertise in such areas as HIPAA, nursing homes, managed care, mental health, medical ethics and long-term care.

Health Law Section Reports

Please find attached the Health Law Section COVID-19 Resolutions, as clarified and revised since June 2020. These revised Resolutions will be submitted to the New York State Bar Association (NYSBA) House of Delegates (HOD) for review, consideration and formal action on November 7th , 2020.

Also attached is the full Health Law Section COVID-19 Report which was submitted to the HOD for its June 13th meeting. The attached version, revised September 20th, reflects technical corrections. The Health Law Section COVID-19 Report is provided for information and reference, and not for the purposes of consideration by the HOD at its November meeting.

Proposed Department of Health Rule by the NYSBA Health Law Section – The proposed rule would revise: 10 NYCRR 58.1.8: Results of tests to be reported only to physicians or other authorized persons. This proposal would revise New York State regulations to allow research laboratories to disclose research findings that arise in an Institutional Review Board (IRB) approved study, and that may be clinically significant, to the health care provider designated by the study subject.

Summary Report on Healthcare Costs: Legal Issues, Barriers and Solutions

SUMMER DIVERSITY FELLOWSHIP IN HEALTH LAW APPLICATION DEADLINE

The New York State Bar Association (NYSBA) Health Law Diversity Fellowship Program was developed in 2011 by the Health Law Section as part of the New York State Bar Association’s Diversity Challenge to develop and execute initiatives to increase the diversity of its membership, leadership and programs.

The Fellowship is operated in partnership with and administered by the New York State Bar Foundation.  The primary goal of the Diversity Summer Fellowship in Health Law is to increase the representation of lawyers and students from a diverse range of health law backgrounds due to the ambition of NYSBA’s Diversity Challenge and provide students an opportunity to experience health law practice.

Eligibility – Law student from a diverse background must be enrolled in a New York State accredited law school.

Length – 8 weeks

Paid Stipend – $6,000
