With the reality of an extended and gradual return to “normal” and the likelihood of disrupted court dockets for many months, we are all feeling the increased pressure to consider virtual options. The most daunting challenge is figuring out more about how these processes work. Are they secure? Are they confidential? Are they fair? Do they yield enforceable awards? Can we make progress and settle matters? How can we zealously advocate from our “home” offices? Does virtual ADR work?

- Important new factors to consider in the pre-session preparation steps,
- Getting comfortable with the virtual platform (addressing privacy and confidentiality concerns, building comfort with the new bells and whistles, lining up alternate simultaneous communication channels)
- Advocacy tips for this “new normal” (facilitating meaningful connections and reading the virtual room, remote testimony techniques, successfully sharing exhibits, signing and executing agreements)
