33 million people, more than 50% of Medicare beneficiaries, receive their in-patient and out-patient coverage under Medicare Advantage plans. But Medicare Advantage Organizations (MAOs) are under increasing scrutiny for a variety of billing, claim review, and marketing practices– including in False Claims Act (FCA) cases brought by the federal government and whistleblowers. This CLE will offer perspectives on the FCA's application to the Medicare Advantage program from current and former government attorneys with deep experience in such FCA investigations and litigation as well as a basic introduction to the structure of Medicare Advantage.
