Burning Topics in Commercial Cannabis and CBD Litigation
This hour-long program will give an overview of some of the critical issues being litigated in New York and around the country as cannabis and CBD become a more and more important part of the economy. After a brief overview of NY’s recently passed Marijuana Regulation and Taxation Act, we will look at cannabis joint venture disputes, “hot hemp” litigation, issues of federal courts enforcing state cannabis law, the anticipated role of Article 78 proceedings in battles for commercial licenses, the interplay of arbitration and courts in cannabis disputes, cases involving employment law and cannabis, and tricky issues relating to insolvency. There are even some novel constitutional law questions that cannabis cases have raised that the panel will cover.
