Defensive Estate Planning For LGBTQ Couples After The Supreme Court’s Decision In Dobbs

Defensive Estate Planning For LGBTQ Couples After The Supreme Court’s Decision In Dobbs

Defensive Estate Planning for LGBTQ Couples_675

With at least one concurring opinion of the Supreme Court’s decision in the June 2022 Dobbs v Jackson Women’s Health Organization openly inviting challenges to marriage equality, this panel focuses on both practical and policy advice for Trusts & Estates attorneys representing LGBTQ couples in its aftermath. This program focuses on:

  • historic prejudice and bias the LGBTQ community has faced in laws concerning death and inheritance, and how marriage equality addressed decades of legislative shortfalls;
  • the Dobbs decision and the status of subsequent litigation challenging marriage equality or interstate recognitions of LGBTQ couples since June 2022;
  • the unique impact of the Dobbs decision has on LGBTQ equality;
  • how attorneys can better serve clients in the LGBTQ community to promote diversity and inclusion in their practices by creating welcoming environments; and
  • steps that attorneys can take to protect LGBTQ couples in their wills and advance directives.
