Defensive Estate Planning For LGBTQ Couples After The Supreme Court’s Decision In Dobbs
With at least one concurring opinion of the Supreme Court’s decision in the June 2022 Dobbs v Jackson Women’s Health Organization openly inviting challenges to marriage equality, this panel focuses on both practical and policy advice for Trusts & Estates attorneys representing LGBTQ couples in its aftermath. This program focuses on:
- historic prejudice and bias the LGBTQ community has faced in laws concerning death and inheritance, and how marriage equality addressed decades of legislative shortfalls;
- the Dobbs decision and the status of subsequent litigation challenging marriage equality or interstate recognitions of LGBTQ couples since June 2022;
- the unique impact of the Dobbs decision has on LGBTQ equality;
- how attorneys can better serve clients in the LGBTQ community to promote diversity and inclusion in their practices by creating welcoming environments; and
- steps that attorneys can take to protect LGBTQ couples in their wills and advance directives.
