This program will provide a comprehensive overview of Dram Shop liability in New York, including the statutory framework under General Obligations Law §§ 11-101 and 11-100 and Alcoholic Beverage Control Law § 65. Attendees will gain a clear understanding of when liability attaches to alcohol vendors, with a focus on unlawful sales to visibly intoxicated persons and minors, and the policy considerations underlying these laws.


The program will also explore key litigation issues, including proving “visible intoxication,” establishing causation, and navigating defenses such as voluntary intoxication and guilty participation. Through discussion of recent case law and practical examples, participants will learn how courts evaluate evidence, assess liability, and apply the Dram Shop Act in a variety of contexts, from taverns and restaurants to social host scenarios.
