2:00 p.m. – 2:55 p.m. Siting Renewable Energy & Other Natural Resource Intense Projects – Are Host Community Benefit Agreements helping to Overcoming NIMBY (Not In My Backyard) Opposition
Upstate New York now provides most of the State’s drinking water, waste disposal facilities, renewable energy siting locations, and local organic farm-produced food. This program will explore the impacts taking place in upstate New York and the Host Community Benefit Agreements necessary to continue this trend.

3:00 p.m. – 3:55 p.m. Cannabis – Is Your Community Going to Opt in or Out?
Local governments will face many choices as the new Marihuana Regulation and Taxation Act, Chapter 92 of the Laws of 2021 is gradually implemented. The most immediate decision is whether to opt out, and thus prohibit retail dispensary and delivery licenses through the adoption of a local law by December 31, 2021. Given that regulations governing license applications and operations will not likely be finalized by the end of the year, some municipalities may opt out, knowing that such decisions can be reversed at any time in the future. Those not opting out will face decisions about whether to revise their zoning, as well as commenting on any license applications proposed for their jurisdiction. This panel will explore the pros and cons of opting in or out by the end of this year.

4:05 p.m. – 5:00 p.m. Brownfield Redevelopment in Environmental Justice Communities – Hear from the Developers Successfully Implementing these Projects
This distinguished group of developers will discuss their NYS Brownfield Cleanup Projects in some of the most challenging NYS brownfield environmental justice areas, and how they overcame financing and other challenges through use of the Brownfield Cleanup Program and other strategies. The group will also discuss why the BCP should be extended next year to continue to enable these projects in EJ areas throughout the State.

9:00 a.m. – 9:55 a.m. PFAS Was Found in Our Drinking Water Supply – What Do We Do Now?!
This panel will discuss Newburgh’s discovery of a new type of contamination known as “PFAS” in its drinking water supply and how it has been struggling to find solutions to clean up its contaminated water supply and find alternative sources of water in the interim. In addition, the panel will explore remedial technologies available to remove PFAS contamination from drinking water supplies and any grant programs available to help municipalities pay for such remediation systems.

The Brownfield Opportunity Area (BOA) Program– What is New with the BOA Program and How to Leverage its Benefits
The NYS BOA Program is now 17 years old and has recently changed. This session will provide an update of the changes to increase implementation of BOA projects. The panel will also discuss how the BOA program identifies strategic investment opportunities and leverages multiple funding and financing opportunities once a BOA is designated, including some case studies. The key role municipalities and economic development agencies play in brownfield area redevelopment, including opportunities for new municipalities to participate, will complement the discussion.

11:05 a.m. – 12:00 p.m. The Impact of Climate Change, the Energy Transition and Executive Order 14008 on Petrostates (Petroleum Producing Nations) in Developing Economies
A world-renowned speaker on Climate Change, Environmental Justice and the Renewable Energy Transition, Law Professor Tracy-Lynn Field will discuss how the energy transition of the Biden Administration has created a new landscape of opportunities and challenges for developing economies and the U.S., particularly as it relates to U.S. funding of natural gas as a transition fuel and infrastructural developments for renewable energy projects. This session shall discuss funding from Wall Street and other U.S. financial institutions involved in funding renewable energy projects in the U.S. and globally.

11:05 a.m. -11:55 a.m. Update on Enacted and Pending Legislation and Recent Case Law Affecting Municipalities
This session will review enacted and pending legislation from the 2021 NYS Legislative Session. In addition, the presentation will review recent court decisions that have been issued over the past year that have particular importance to attorneys who practice municipal law.

12:00 p.m. – 1:00 p.m. Crumbling Foundations In Light of the Surfside Florida Disaster – Ethical Obligations of Municipal Attorneys in Light of Impending Catastrophe
The recent Surfside building collapse in Florida has brought to light that buildings have a finite life and can collapse after a certain age without major structural repairs. And it has highlighted several failures, including governmental inspectors and local homeowners association boards. This session will discuss the professional obligations of municipal attorneys as they deal with these and related issues. Further, we will discuss the consultant’s role in assisting lawyers in providing legal advice on these issues to their clients.

Taughannock Falls State Park's namesake waterfall is one of the outstanding natural attractions of the Northeast. Taughannock Falls plunges 215 feet past rocky cliffs that tower nearly 400 feet above the gorge. Gorge and rim trails offer spectacular views from above the falls and from below at the end of the gorge trail. Take a shuttle to the falls lookout for a beautiful view, and there is an easy flat-level walk to view the falls close up. Other trails are available for the more adventurous. Shuttle bus will depart the falls to return to the hotel at 3:30 p.m. and 4:30 pm. The Falls are approximately a 20 minute drive from the hotel.
