Handling Prevailing Wage Matters in New York (NYLL Art. 8)

What are prevailing wages and when must an employer working in New York City or New York State pay them? How is an employer/employee supposed to know prevailing wage requirements apply to a worksite? In this program, a panel of private sector practitioners will join attorneys from the New York State Department of Labor and the New York City Comptroller’s Office to answer these and other questions that arise in this complicated area of the law.
The panel will discuss how and when prevailing wage laws apply to “public works” in New York State and New York City; the primary obligations on contractors and sub-contractors working on public work projects; compliance with prevailing wage laws, including an explanation of the main resources and guidelines available to contractors and sub-contractors from state and city governments; how to identify and obtain information concerning construction projects subject to prevailing wage requirements; how government agencies work independently and collaboratively to investigate and prosecute claims for unpaid prevailing wages; how claims for unpaid prevailing wages are litigated and resolved, both in private actions in courts and in enforcement proceedings before government agencies; and damages and penalties available in prevailing wage actions.
