What is a judgment exactly? CPLR 5011 “the determination of rights or the parties in an action or special proceeding and may be either interlocutory or final.”
What Is Judgment Enforcement? Winning a case and obtaining a judgment is nice! But judgment debtors do not always pay a judgment. So…a judgment is not money. It entitles your client to money, but you sometimes need to take active steps to turn a judgment into money. Judgment enforcement is about those active steps. How do you do it? By using the tools contained in CPLR Article 52 (and some others). Judgment enforcement is part of a litigator’s tool bag; it can also be a practice area unto itself.
