Tension oftentimes exists between fiduciaries and estate and trust beneficiaries. Although beneficiaries regularly petition to remove estate and trust fiduciaries, beneficiaries do so to varying degrees of success. This presentation will address the statutory grounds for removing estate and trust fiduciaries, the procedural steps associated with successfully seeking removal, the availability of suspension under SCPA 712, and the strategies that fiduciaries can employ to avoid removal or suspension.
