The Stop Hacks and Improve Electronic Data Security Act (S.5575B/A.5635) (SHIELD Act) information security provisions, governing the storage, use, protection, disposal, and data breach notification of New York resident’s private information, became effective on March 21, 2020. New York lawyers and law firms (of all sizes) hold significant amounts of personal information that subjects them to new statutory requirements, recommendation to adopt an information security program, and ethical dilemmas in compliance.
