The Stop Hacks and Improve Electronic Data Security Act (S.5575B/A.5635) (SHIELD Act) information security provisions, governing the storage, use, protection, disposal, and data breach notification of New York resident’s private information, became effective on March 21, 2020. New York lawyers and law firms (of all sizes) hold significant amounts of personal information that subjects them to new statutory requirements, recommendation to adopt an information security program, and ethical dilemmas in compliance. This program provides an overview of the scope of the SHIELD ACT, the new information security requirements, penalties for breach, applicable legal ethical principles, and types of products available to the legal sector to assist in compliance with the SHIELD Act’s reasonable security requirement. Join us in a succinct presentation covering the statutory, ethical, and cybersecurity issues posed by the SHIELD Act accessible to highly technological lawyers as well as tech wary legal practitioners.
