Compensated Gestational Surrogacy Has Arrived

In February 2021, the ban against compensated gestational surrogacy in New York State will be lifted. This sweeping legislation, known as The Child Parent Security Act, overturns a 30-year prohibition against such collaborative reproduction arrangements, thereby amending the Domestic Relations Law, the Family Court Act and many other statutes. The statute legalizes and regulates enforceable compensated gestational surrogacy agreements (where the surrogate has no genetic connection to the child), modeling and improving upon industry best practices to provide substantial protections for the person acting as surrogate, the intended parents, and the child. This program will address these protections, the statute’s requirements, and a step-by-step of analysis of the novel process of obtaining a judgment of parentage to establish and secure legal parentage. This is part two to the Annual Meeting program on January 28th and will answer any questions posed during that meeting.
