From the Article 81 Guardianship Administration to the Estate Administration
The Mental Hygiene Law Article 81 guardian must look to the statute and applicable caselaw for guidance in transitioning the guardianship estate to the decedent’s estate fiduciary. This program will explore the applicable law and practical considerations involved in this transition from both the guardian’s perspective and the estate fiduciary’s perspective. We will examine the powers, duties, and limitations of the guardian in wrapping up the guardianship, with attention to the timeline set forth in the Mental Hygiene Law. Following that timeline against the timeline of an ordinary estate administration, we can anticipate issues that might arise and how to address them. We will also address litigation in the deceased incapacitated person’s estate in both the guardianship proceeding and the Surrogate’s Court.
