How Many Parents May a Child Have According to DRL § 70?
Domestic Relations Law § 70 authorizes the Court to award custody to ‘either’ parent, presuming parentage is limited to two. With the NY Court of Appeals decision in Brooke S.B. v. Elizabeth A.C.C. expanding the definition of parent and the progeny of cases thereafter recognizing different pathways to parentage, has New York grown out of its statutory framework? And if so, then into what? This program will explore whether DRL § 70 needs to be modified and what we should expect from evolving caselaw.
