Federal Information Blocking Requirements
Who do the regulations apply to and what do providers (and their health IT vendors) need to do? New CMS regulations prevent healthcare providers from “information blocking,” or interfering with access or exchange of ePHI, and require that providers identify all potential “information blocking” practices. This talk will discuss such, including requirements that hospitals must use “reasonable efforts” to collect the information required and send ADT notifications to post-acute care service providers and suppliers as well as to primary care and other practitioners with whom the patient has an established relationship, that hospitals determine what access parents can have as to minor records, that providers not delay the release of test results, etc.

Telemedicine – What is The Current State of the Law With Telemedicine Both Federally and in NY, and What Can We Expect to Continue
The use of telemedicine has increased exponentially during the pandemic, assisted by Medicare now allowing telemedicine anywhere in the country, an expansion of the types of practitioners allowed to practice telemedicine, an announcement by the federal Office of Civil Rights to waive potential penalties for HIPAA violations against health care providers that serve patients through everyday communications technologies during the COVID-19 nationwide public health emergency, as well as state decisions to allow practice by telemedicine in certain circumstances and more. This panel will discuss the legal issues involved with use of telemedicine now and predictions for the future.

340B Issues – What is Happening and How Does it Affect NY Providers
This session will cover the prescription drug discount program established under Section 340B of the federal Public Health Service Act, which enables certain types of health care providers to purchase outpatient prescription drugs at discounted prices for their patients. The session will focus on recent developments in the 340B program, including the controversy decisions by drug manufacturers to stop furnishing 340B drugs to contract pharmacies and efforts to address Medicaid duplicate discounts.
