When questions arise concerning a fiduciary’s conduct, the Surrogate’s Court oftentimes resolves the issues in contested accounting proceedings. This program will address procedural and substantive issues of which practitioners handling contested accounting proceedings should be aware, including but not limited to compelling an accounting, filing an accounting, requesting pre-objection discovery, prosecuting objections, CPLR Article 31 disclosure, dispositive motion practice, and trial. In addition, the program will cover issues that may arise in seeking to enforce judgments that may result from contested accounting proceedings, the use of provisional remedies in accounting proceedings, and contempt.
