The Intersection of e-Discovery and Foreign Parties & Laws

Multinational business entities create and store electronic information across the world. That information may be relevant to civil and criminal proceedings and an entity might be requested to produce information across borders. This CLE program will address how electronic information stored outside the United States can be requested in American litigation and how American courts analyze contested requests for production. The program will also consider how the GDPR might restrict production and the effect of the recently-enacted CLOUD Act on demands for production made by prosecutors.
