This program provides counsel with a roadmap for understanding contractual indemnification claims and outlining best practices for drafting indemnification language on behalf of construction clients. In addition to analyzing disputes that arise when interpreting indemnity agreements, and focuses on common triggering factors, the differences between contractual and common law indemnification claims, legislative limitations, litigation strategies in both prosecuting and defending indemnification claims, practical points when advising construction clients on indemnification language, respondeat superior implications where the employer is the indemnitor and recent caselaw developments.
