Big Data and False Claims Act Risk Due to COVID-19
This presentation is targeted to general counsel, health care counsel, white-collar defense counsel, and compliance officers. This presentation will provide a broad understanding of the growing use of data to find, support, and allege FCA violations. Unlike an in-depth analysis of the current state of the law, the presentation is focused on the pre-litigation process of the government agencies and parties involved in auditing, data analysis, and the procedures that lead up to a determination to assert FCA violations or intervene. Attendees will gain an understanding of how the dramatic regulatory changes to the delivery of health services due to the COVID-19 pandemic significantly increased the opportunity for fraud and the level of non-compliance, both of which could be subject to FCA litigation. Finally, attendees will walk away with practical advice that can be immediately implemented to reduce risk.
