Social issues – we have that covered with a 1-hour CLE Diversity and Inclusion Credit presentation entitled: The Role Implicit or Explicit Bias has Played in Shaping New York’s Environmental Policy – Combatting Racial Injustice. Overall, the Program provides a timely look at new legislation, regulations and guidelines, as well as current issues affecting energy and environmental practice throughout the State with a “brief” look back at the history of the Section to celebrate our 40th anniversary and concluding with a keynote address by Joe Martens, Director, New York Offshore Wind Alliance.
This program is being held as two separate non-consecutive days, if you wish to attend both days you must register separately both days. The first day focuses on Environmental Law, the second day focuses Energy Law.

Emerging Trends and Issues in Environmental Due Diligence
This panel will discuss how due diligence practices may change following the anticipated revisions to the ASTM E1527-13 Phase I standard to be released in 2021, as well as challenges posed by the COVID-19 pandemic. The panel will review key anticipated revisions to ASTM E1527, how to evaluate Phase I reports that were completed during the COVID-19 shutdown, how to assess COVID-related operational changes, and lessons learned from consultant experience and litigation.

PFAS Remediation – DEC’s New Screening Levels and The Latest Trends in Remediation Technologies
This panel will have NYSDEC provide an update on the new Maximum Contaminant Levels (MCLs) for Emerging Contaminants PFOA, PFOS and 1,4-dioxane and describe new PFAS soil and groundwater screening levels applicable to all remediation sites. Panelists will describe the state-of-the art remediation technologies being developed to address this contamination as well as the current soil and groundwater sampling and disposal challenges. Panelists will also provide the legal perspective on the impact emerging contaminants are causing in contaminated real estate transactions.
