Estate and Trust Transfers: Market-Rate Co-ops and Condos, and HDFCs – Video Replay

This program will include a segment on shareholder and unit owner requests to transfer co-op and condo apartments to trusts for estate planning, risk management and/or other purposes, and the legal basis boards have to oversee these transfers, potential exposure to co-ops and condos, and recommended solutions and documentation to address transfer-related issues.

In addition, this program will include a segment on how co-op boards should approach the death of a shareholder, the proper transfer of a decedent’s shares to an heir or sale by the Estate to a third party, what to do if a deceased shareholder’s next of kin fails to act, how a co-op may be able to petition the public administrator as a creditor, and how many of the above-mentioned issues are handled in HDFC co-ops.
