Health Law Section Fall Meeting 2021 (Day 2)
The Health Law Section 2-day Fall CLE Program will examine and invite discussion about a range of hotly debated and cross-cutting issues in health care today, including long-term care, maternal mortality and morbidity, data privacy, and vaccination mandates and equity and access. Speakers will bring a New York perspective to the focus of their presentations and panels, addressing practical skills for attorneys in counseling and representing clients in the various areas of the law.

Panel #2 The State of Health Data Privacy Protections

Health data are a powerful tool for informing adaptive statistical models leading to improved diagnoses, health outcome predictions, care improvement recommendations, and treatment recommendations. Sharing and using health data implicate the rights of people who consent to providing the information, and these uses can also lead to harm. This panel will examine the current state of health data privacy laws across the United States with a specific focus on New York State health data privacy laws and proposals, and will consider how the regulatory landscape impacts individuals, especially marginalized, disadvantaged, and vulnerable populations.
