Practicing Criminal Law Amid a Landscape of Social Reform
The Committee on Mandated Representation and the Criminal Justice Section present this CLE to help lawyers navigate practicing criminal law in light of the social changes that happen daily. This program will bring you up to date on gun reform and how it affects 4th amendment issues from trial to the appellate level. Additional topics include addressing consequences and options for LGBTQ+ incarcerated individuals. We will also review various aspects about conviction integrity units, as well as address types of digital discovery and cybersecurity issues.

11:10 a.m. – 12:00 p.m. Your Trans Client Just Got Sentenced to State Time. Now What? How to Request Gender Aligned Placement
This presentation will explore legal issues concerning housing for gender diverse populations facing a period of state incarceration. We will provide an LGBTQ+ Cultural Competency foundation that will assist participants to be sensitive to the needs of their gender diverse clients. The presentation will also explore the legal landscape concerning placements in gender aligned correctional settings and will specifically review the policies and practices currently in place at the New York State Department of Corrections and Community Supervision. Participants will increase their knowledge concerning sexual orientation, gender identity and gender expression, and will gain an understanding of how DOCCS accommodates gender diverse populations, so they are better able to advise their clients. Finally, participants will learn how to request a gender aligned placement on behalf of a client.
